Terms of Service

These Terms of Service ("Terms") govern your use of the TheOGMarket platform ("Platform") operated by TheOGMarket ("we", "us", or "our"). By creating an account or using the Platform you agree to these Terms.

1. The Platform

TheOGMarket is an email deliverability intelligence service. It allows registered Senders to test how their emails are placed (inbox, promotions, spam) across a panel of real Gmail accounts contributed by Panelists.

2. Sender Accounts

As a Sender, you agree to:

• Use the Platform only to test deliverability of email you are authorised to send
• Not use the Platform to send spam, phishing emails, or any content that violates applicable law
• Not attempt to manipulate, reverse-engineer, or abuse the placement results
• Not share your account credentials with third parties
• Maintain accurate contact information on your account

Accounts found to be in violation may be suspended or permanently terminated without prior notice.

3. Panelist Participation (Invite-Only)

Panelist membership is strictly invite-only. You may only become a Panelist if you have received a personal invitation issued by TheOGMarket.

As a Panelist, you agree to:

• Connect only Gmail accounts that you own and have full authority over
• Maintain your connected account in good standing throughout your participation
• Not artificially manipulate placement signals (e.g. manually moving test messages)
• Notify us promptly if your Google account access changes

Panelists may withdraw from the panel at any time by revoking OAuth access via Google Account Permissions or by contacting us. Upon withdrawal, all stored credentials are deleted.

4. Compensation for Panelists

Panelists who actively contribute their inbox to the platform may receive compensation as agreed at the time of invitation. Compensation rates, schedules, and payment methods are defined in the individual panelist agreement issued with your invite. TheOGMarket reserves the right to modify compensation terms with reasonable notice.

5. Acceptable Use

You must not:

• Use the Platform in any way that violates applicable law or regulation
• Attempt to gain unauthorised access to any part of the Platform or its infrastructure
• Use the Platform to facilitate spam, phishing, or malware distribution
• Scrape, copy, or redistribute Platform data without written permission
• Use automated tools to abuse the free-tier test allowance

6. Service Availability & Accuracy

We aim to provide accurate deliverability data but make no guarantee of the completeness or accuracy of placement results. Results depend on the size and composition of the panel at the time of testing. The Platform is provided "as is" without warranties of any kind.

We may suspend the service for maintenance, upgrades, or in response to security incidents without prior notice.

7. Intellectual Property

All Platform software, algorithms, trademarks, and content are the property of TheOGMarket. You may not copy, modify, distribute, or create derivative works without our written consent.

8. Limitation of Liability

To the maximum extent permitted by law, TheOGMarket shall not be liable for indirect, incidental, special, or consequential damages arising from your use of or inability to use the Platform.

9. Termination

We reserve the right to suspend or terminate any account at our discretion for violations of these Terms. You may close your account at any time by contacting us via the contact form.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms. Material changes will be communicated by email.

11. Governing Law

These Terms are governed by applicable law. Any disputes shall be resolved through good-faith negotiation before pursuing any formal proceedings.
